1. Acceptance of these Terms
These Terms of Service ("Terms") form a legally binding contract between you ("you" or "Merchant") and Skyfleet ("Skyfleet", "we", "us") governing your access to and use of the Skyfleet platform at skyfleetnow.com, associated APIs, and mobile applications (collectively, the "Platform").
By signing up for an account, accessing the Platform, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
These Terms are published in accordance with Rule 3(1)(a) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and constitute an "electronic record" within the meaning of the IT Act, 2000.
2. About Skyfleet (Seller information — CP E-Commerce Rules)
In compliance with Rule 5(3) of the Consumer Protection (E-Commerce) Rules, 2020, the following information is disclosed:

Skyfleet operates as an intermediary within the meaning of Section 2(w) of the IT Act, 2000, providing technology that connects merchants with third-party courier and logistics partners. Skyfleet does not itself carry out physical transportation and is not a courier company.
3. Eligibility and account
You may use the Platform only if you:
- Are at least 18 years of age and competent to contract under the Indian Contract Act, 1872;
- Are registering on behalf of a legal entity (proprietorship, partnership, LLP, company, society, trust) that you are authorised to bind;
- Hold or will hold a valid GSTIN where required by the GST law (turnover threshold) and provide accurate tax registration details;
- Comply with all applicable laws, including export-control laws when shipping internationally.
You are responsible for all activity on your account. Keep your password and 2FA codes confidential. Notify us immediately at support@skyfleetnow.com of any unauthorised use.
4. The services
Skyfleet provides the following services through the Platform:
- Real-time rate comparison across multiple courier partners;
- Booking of shipments with chosen courier partners;
- Generation of shipping labels and tax invoices;
- Tracking of shipments and provision of webhook events;
- Cash-on-Delivery (COD) remittance and net-off of freight charges;
- Non-Delivery Report (NDR) and Reverse Pickup (RVP) management;
- Customer communication via WhatsApp Business and SMS (Connect);
- Dispute management for weight discrepancies;
- Such other features as we may add or modify from time to time.
5. Your obligations as a Merchant
You agree that you will:
- Provide accurate, complete, and current information about yourself, your business, and every shipment (including weight, dimensions, value, declared contents, recipient details);
- Not ship prohibited or restricted items through the Platform, including but not limited to: cash, gold or precious metals, narcotics or psychotropic substances, firearms or weapons, explosives, hazardous chemicals, perishable food items (unless courier specifically permits), live animals, human remains, counterfeit goods, infringing goods, or any item prohibited under the Carriage by Road Act 2007, Indian Aircraft Rules, IMDG Code, or destination-country import controls;
- Comply with all applicable laws for the products you ship, including labelling, BIS certification, drug licensing, e-waste rules, FSSAI requirements, and customs declarations for international shipments;
- Obtain appropriate consents from end consumers to share their personal data with Skyfleet and the chosen courier partner;
- Pay all charges due under Section 8;
- Not use the Platform for any unlawful, fraudulent, or abusive purpose; not attempt to reverse-engineer, scrape, or extract our data outside the documented API;
- Indemnify Skyfleet for any loss, claim, fine, or penalty arising from your breach of these obligations (Section 13).
6. Prohibited content and conduct
In compliance with Rule 3(1)(b) of the IT (Intermediary Guidelines) Rules, 2021, you will not host, display, upload, modify, publish, transmit, store, update, or share any information that:
- Belongs to another person and to which you do not have any right;
- Is defamatory, obscene, pornographic, paedophilic, invasive of privacy, insulting on the basis of gender, libellous, racially or ethnically objectionable;
- Is harmful to a child;
- Infringes any patent, trademark, copyright, or other proprietary rights;
- Violates any law in force;
- Deceives or misleads the addressee about the origin of the message, or knowingly and intentionally communicates any misinformation;
- Impersonates another person;
- Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, public order, or causes incitement to the commission of any cognisable offence;
- Contains software viruses or any other computer code, file, or programme designed to interrupt, destroy, or limit the functionality of any computer resource;
- Is patently false and untrue, and is written or published in any form with the intent to mislead or harass any person.
7. Pricing and plan tiers
Plans are described on our Pricing page. All prices are exclusive of applicable GST and other taxes, which will be added to your invoice as per Indian tax law.
We may revise prices on at least 30 days' prior notice sent to your registered email. Continued use after the effective date constitutes acceptance of the revised prices. Existing booked shipments will not be re-priced.
8. Payments, COD net-off, invoicing
Per-shipment freight is charged at the courier-specific rate applicable at the time of booking. Rates are visible to you before you confirm the booking.
COD net-off: for Cash-on-Delivery shipments, the courier collects COD from the recipient and remits the amount to Skyfleet. We deduct freight, any weight-discrepancy charges, and any taxes, and remit the balance to your registered bank account on the cycle you have configured (D+1, D+3, D+7, or weekday-specific).
Prepaid invoicing: for prepaid shipments and subscription plans, we raise GST-compliant tax invoices on a weekly or monthly cycle. Invoices are due net of 7 days from invoice date unless otherwise agreed.
Late payment: overdue amounts may attract interest at 1.5% per month (or part thereof). We may suspend access to the Platform until overdue amounts are paid.
Taxes: Skyfleet charges GST as applicable. Place of supply is determined in accordance with the IGST Act, 2017. For international shipments, IGST refund support via Letter of Undertaking (LUT) is available if the merchant has filed an LUT with the GST department.
9. Returns, cancellations, refunds (CP E-Commerce Rule 5(3))
Cancellation of a booking: shipments not yet picked up by the courier may be cancelled from the dashboard at no charge. Once a courier has picked up the shipment, cancellation is subject to the courier's policy and may attract cancellation charges.
Refunds: where a shipment is cancelled before pickup and freight has been pre-billed, the freight amount will be credited back to your account within 7 working days.
Damaged or lost shipments: claims for damage or loss are governed by the courier's carriage liability terms. Skyfleet will assist with claim filing but is not itself the carrier. Maximum carrier liability is typically capped at ₹2,500 or twice the freight charge, whichever is lower, unless a higher value insurance was purchased at the time of booking.
Weight discrepancies: where a courier re-weighs a package after pickup and adds charges, the discrepancy is surfaced in your dashboard within 48 hours. You have a 7-day window from notification to dispute the discrepancy with evidence (packaging video, product dimension photo). Disputes are reviewed within 5 working days. Undisputed discrepancies are deemed accepted after the 7-day window.
Subscription plan refunds: monthly subscription fees are non-refundable for the current month. Cancellation takes effect from the end of the current billing cycle.
10. Courier services and limitations
Courier services are provided by third-party courier partners. Skyfleet is not responsible for delays, damage, loss, mis-delivery, or non-delivery caused by the courier. We will support you in escalating issues to the courier and recovering claims where applicable, but the courier's carriage liability terms govern recovery.
Transit times indicated on the Platform are estimates only and are not guarantees.
11. Intellectual property
All intellectual property in the Platform, including the brand "Skyfleet", the logo, software code, design, documentation, and content, is owned by Skyfleet or our licensors. You are granted a limited, revocable, non-exclusive, non-transferable licence to use the Platform for your business purposes, subject to these Terms.
You retain ownership of the merchant data and shipment data you submit. You grant Skyfleet a worldwide, royalty-free, non-exclusive licence to use, host, store, copy, transmit, and display such data solely as necessary to operate the Platform and provide the services.
12. Warranties and disclaimers
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Skyfleet disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or completely secure, although we work to maintain high availability and security as described in our Privacy Policy.
13. Limitation of liability and indemnity
To the maximum extent permitted by law, Skyfleet's aggregate liability arising out of or relating to these Terms or the Platform will not exceed the greater of (a) the freight and subscription fees you have paid to Skyfleet in the 12 months preceding the event giving rise to the claim, or (b) ₹10,000.
Skyfleet will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profit, revenue, goodwill, or data, even if advised of the possibility of such damages.
You agree to indemnify and hold harmless Skyfleet, its directors, employees, and partners against any claims, damages, fines, or penalties arising from (i) your breach of these Terms, (ii) your shipment of prohibited or restricted items, (iii) inaccurate information provided by you, (iv) infringement of third-party rights by your shipments, or (v) any violation of applicable law by you.
14. Suspension and termination
By you: you may close your account at any time from the dashboard, or by emailing support@skyfleetnow.com. Outstanding shipments must be completed and all dues cleared before closure.
By Skyfleet: we may suspend or terminate your account immediately if we reasonably believe that (i) you have breached these Terms, (ii) you have shipped prohibited items, (iii) you have engaged in fraudulent conduct, (iv) you have failed to pay overdue amounts after 14 days' written notice, or (v) we are required to do so by law.
Sections 8 (Payments), 11 (Intellectual property), 12 (Warranties), 13 (Liability), 15 (Governing law), and 16 (Grievance) survive termination.
15. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles.
Step 1 — Internal escalation: any dispute should first be raised with our Grievance Officer (Section 16). We will work in good faith to resolve it within 30 days.
Step 2 — Arbitration: if not resolved, the dispute will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration is Chandigarh, India. The language of arbitration is English. The award is final and binding.
Step 3 — Courts: subject to arbitration above, the courts at Chandigarh, India have exclusive jurisdiction over any matter arising from these Terms.
Nothing in this section limits a consumer's rights to approach a consumer commission under the Consumer Protection Act, 2019.

In compliance with Rule 4(1)(d) of the Consumer Protection (E-Commerce) Rules, 2020 and Rule 3(2) of the IT (Intermediary Guidelines) Rules, 2021, we have designated a Grievance Officer:

17. Modifications to these Terms
We may update these Terms from time to time. Material changes will be notified to you via email and via an in-app notice at least 7 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may close your account before the effective date.
18. Severability, waiver, and entire agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
No failure or delay by either party to exercise any right under these Terms constitutes a waiver of that right.
These Terms, together with the Privacy Policy and any plan-specific or product-specific terms expressly referenced herein, constitute the entire agreement between you and Skyfleet regarding the Platform and supersede all prior agreements, communications, and understandings.
